Cross Media Ltd., henceforth referred to as ‘CM’, ‘Company’ or ‘we’ and performers at HYPER JAPAN 2022 henceforth referred to as ‘Performer’ or ‘you’ do hereby agree to the following Terms and conditions laid out in this document, as they pertain to any performance(s) carried out at the HYPER JAPAN Festival 2022, henceforth referred to as ‘Event’, held from 22nd to 24th July 2022 at Evolution London, Battersea Park, Chelsea Bridge, Queenstown Rd, London SW11 4NJ. This document will also serve as a contract to your performance(s) at HYPER JAPAN Festival 2022.

By agreeing to this Agreement, it is understood that the Performer agrees to the following Terms.

  1. CM agrees to carry out the following actions for the Performer as part of the contract:
    • Provide stage and equipment as described in the Performer Manual and Performer Application Form.
    • Provide support for performers at HYPER JAPAN Festival 2022.
    • Set up equipment as directed in set up document as best as possible.
    • PR on our available online platforms whether via SNS or other relevant mode of advertising. (Web page, Newsletter etc.)
  2. The Performer hereby agrees to carry out the following actions as part of the contract.
    • To appear at the Main Stage or Festival Stage for predetermined performance(s) (the ”Performance”) at the Event.
    • To adhere to the performance guidelines in the Performer Manual
    • To appear on stage as agreed with the Organiser.
    • Agree to assist in publicity efforts carried out by CM. Any publicity materials required for such efforts will be provided by the Performer in a timely manner.
  3. Filming: 
    • The Performer agrees with CM to film and/or photograph any Performance which take place, and that any and all photograph and/or film taken of the Performer by CM, or agents of CM, may be used without further permission from the Performer for actions directly related to the purpose of publicity.
    • The Performer agrees with CM to edit the recorded videos if any, or use it for promoting and advertising their activities.
  4. Cancellation:                                                                                      
    • Cancellation may occur when both CM and the Performer agree to do so.            
    • In the event that one party is unable to meet the obligations of participation and chooses to cancel, the party wishing to cancel will be responsible for any loss attributable to the cancellation.              
    • Reasons for cancellation outside the ability of CM or the Performer to predict, affect, or solve, shall not be grounds for liability. 
    • In case of, but not limited to, fire, explosion, riot, theft, strike, closure, infectious disease, natural disaster or any such matter outside of the reasonable control of CM or the Performer, the following matters shall not be considered a breach of this Agreement for either CM or the Performer: 
    • Change to or Postponement of Event Period;
    • Change to Preparation and/or Clear-up Conditions;
    • Change of Preparation Period;
    • Cancellation or Postponement of part or all of the Event including the Performance;
    • Change of Venue and Method;
    • Some or all of the Performance are affected by Third Party matters;
    • The number of spectator decreases or there are no spectators;
    • The amenities provided to the Performer break down or are reduced;
  5. Intellectual Property
    • The Service and its content, features and functionality remain the exclusive property of the Company. Stills and video footage taken during the course of the Event belong to the Company and the Company may use this footage for whatever reason. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and Japan. Our trademarks and may not be used in connection with any product or service without the prior written consent of the Company. Any copying of the Event materials (including any stills or videos taken during the course of the Event) or adaptation is strictly prohibited without the prior written permission of the Company.
  6. This Agreement will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
